Shorelines are unique and environmentally sensitive resources which are subject to increasing pressure for a multitude of uses. The market economy fails to optimally allocate use of these resources because much of their value is not easily quantifiable. Washington State's Shoreline Management Act was written in an attempt to require consideration of the environmental benefits of natural shorelines in local land-use decisions. Yet this statute did not account for variables involved in implementation which have caused land-use decisions to diverge from legislative intent.
This thesis examines these issues through a case study of the decade-long process by which the Weyerhaeuser Company sought to secure development perm i t.s for an export facility on the shoreline of Puget Sound at DuPont, Washington. Shoreline Management Act designation of this area as a "shoreline of statewide significance" has not precluded the City of DuPont from allowing intensive industrial use on its coastline.
A variety of factors have resulted in ongoing controversy over the intent of the Shoreline Management Act, and divergence from that intent during its implementation process. Legislative solutions might include clear and concise statutory language and provision for implementation oversight to circumvent such problems in the future.
