Abstract
As part of a global movement, indigenous peoples are attempting to reassert their rights and sovereignty. Paramount among these claims is for the return of human remains and cultural objects, many of which were collected as part of the colonialist endeavor, sometimes under inhumane or illicit circumstances. The United States is unique in their federal-level repatriation policy, referred to as the Native American Graves Protection and Repatriation Act (NAGPRA). This research aims to contextualize NAGPRA as a post-colonial enterprise, acknowledging its successes and its deficits. The inclusion of the Wanapum Band, a non-federally recognized tribe exempt from NAGPRA, into joint repatriation claims represents an illuminating instance where the law's potential shortfalls have been balanced by its deference for tribal claimants. Como parte de un movimiento global, los pueblos indígenas están tratando de reafirmar sus derechos y su soberanía. El más importante de estas afirmaciones es la devolución de los restos humanos y objetos culturales, muchos de ellos recogidos como parte de la empresa colonial, a veces en condiciones inhumanas o casos ilícitos. Los Estados Unidos de América es único en su política de repatriación a nivel federal tomando forma en la Ley para la Protección de las Tumbas Nativas y Repatriación (NAGPRA).
